Fall Protection
The great majority of work related claims in the United States arise from construction site and farming accidents, many related to falls from heights of greater than 6 feet. The Occupational Safety and Health Administration (OSHA) requires workers employ the use of fall protection equipment when working at heights of greater than 6 feet. There are numerous industry exceptions and interpretations used by employers and workers to bypass the fall protection requirements and accidents from falls occur usually resulting in catastrophic results. When is fall protection required? What is proper tie off procedure? What length of protection is sufficient? Is OSHA compliance mandatory? Were the catastrophic injuries suffered caused by improper use of fall protection, improper training, or improper consultant's advice?
Cohen, Placitella & Roth is well versed in OSHA fall protection requirements and how these relate to successful recoveries against third parties in fall protection claims. We look forward to the opportunity to evaluate your fall protection claim.
